Points to Note:

    • The old NSSF rates (under the repealed NSSF Act Cap 258) were in effect until the January 2023 payroll. Following a court case, the new NSSF rates (under the NSSF Act No. 45 of 2013) went into effect in February 2023. The NSSF LEL will increase from KES 6,000 to KES 7,000, and the NSSF UEL from KES 18,000 to KES 36,000.
    • As of Jan 01, 2023, the NHIF amount deducted in this computation is based on NHIF rates effective 01.04.2015.
    • The Kenya Affordable Housing Act, 2024, was enacted on March 19, 2024. It established a Housing Levy of 1.5% of employees’ gross monthly pay, with the employer matching 100% of the employee’s contribution. The levy will be effective from the March 2024 PAYE period. Individuals who are tax residents are entitled to 15% affordable housing relief on their monthly contribution, up to a maximum of KES 9,000 per month or KES 108,000 per year.
    • Effective March 01, 2024, relief includes a monthly personal relief of KES. 2,400, NHIF relief of 15% of an individual’s contribution, and 15% tax relief for Kenyan tax residents who have paid the affordable housing levy. This is consistent with the Kenya Finance Act 2021 (NHIF relief) provisions and the Kenya Affordable Housing Act 2024 (AHL relief).
    • Allowable pension contributions other than NSSF (including NSSF contributions over the statutory amount), mortgage interest on owner-occupier property, contributions to Home Ownership Savings Plans (HOSPs) (now defunct under the Kenya Finance Act 2020), insurance relief (other than the NHIF relief mentioned above), and others are treated differently in this PAYE computation. Don’t hesitate to contact us if you have any questions about such applicable cases.
